We built Perpetual Restaurant Pro to give restaurants more control, more profit, and a simpler system. These terms are designed to be fair, transparent, and easy to understand.

Effective Date: January 21, 2026

Welcome to Perpetual Restaurant Pro (“PRP,” “we,” “our,” or “us”). By using our services, you agree to the following Terms & Conditions.

1. Overview of Services

Perpetual Restaurant Pro provides restaurants with:

  • Website design and hosting

  • Online ordering systems

  • Marketing tools (email capture, loyalty programs, promotions)

  • Optional integrations (POS systems, third-party delivery services, etc.)

  • Ongoing support and system management

Our goal is to help restaurants capture more orders, increase average ticket size, and build repeat business through owned digital systems.

2. Service Structure & Pricing

Pricing may include:

  • One-time setup fee (for onboarding, system build, and installation)

  • Monthly subscription fee (for hosting, maintenance, and support)

  • Optional transaction-based fee (applied to online orders, if applicable)

All pricing is clearly communicated before onboarding and agreed upon in writing.

3. No Long-Term Contracts

We do not require long-term contracts.

  • Services operate on a month-to-month basis

  • You may cancel at any time (see Section 10)

4. Payments & Billing

  • All fees are billed in advance unless otherwise stated

  • Monthly subscriptions renew automatically

  • Failure to pay may result in service interruption or suspension

Restaurants are responsible for maintaining valid payment methods on file.

5. Ownership of Platform & Assets

  • The system, structure, and proprietary setup remain the property of Perpetual Restaurant Pro

  • Restaurants retain ownership of:

    • Their brand

    • Their content (logos, menus, images provided by the client)

If services are canceled, access to PRP-managed systems may be removed unless otherwise agreed upon.

6. Online Orders & Transactions

Perpetual Restaurant Pro facilitates online ordering but does not:

  • Prepare food

  • Handle in-store operations

  • Control order fulfillment or timing

Restaurants are fully responsible for:

  • Order accuracy

  • Food quality

  • Preparation times

  • Customer service related to orders

7. Third-Party Integrations

We may integrate with third-party platforms such as:

  • Payment processors (e.g., Wix Payments, Stripe)

  • Delivery services (e.g., DoorDash Drive)

  • POS systems

We are not responsible for outages, errors, or changes made by third-party providers.

8. Marketing Tools & Performance

We provide tools designed to improve performance, including:

  • Email capture systems

  • Loyalty programs

  • Promotional tools

However, we do not guarantee specific results, including:

  • Revenue increases

  • Order volume

  • Customer retention rates

Performance depends on multiple factors, including restaurant operations and local market conditions.

9. Acceptable Use

You agree not to use our services for:

  • Illegal activities

  • Fraudulent transactions

  • Misrepresentation of products or services

We reserve the right to suspend services if misuse is detected.

10. Cancellation & Termination

You may cancel your service at any time by providing notice.

  • Services remain active through the end of the current billing cycle

  • No partial refunds are provided for unused time

We reserve the right to terminate services if:

  • Terms are violated

  • Payments are not made

  • Misuse or abuse of the system occurs

11. Refund Policy

  • Setup fees are non-refundable once work has begun

  • Monthly fees are non-refundable once billed

12. Limitation of Liability

Perpetual Restaurant Pro is not liable for:

  • Lost revenue or profits

  • Missed orders due to downtime or user error

  • Third-party system failures

  • Operational issues within the restaurant

Our services are provided “as is” without warranties of any kind.

13. Modifications to Services or Terms

We may update:

  • Features

  • Pricing

  • Terms & Conditions

We will provide notice of significant changes when applicable.
